Acceptance of Terms & Conditions

The terms and conditions apply to all visits and transactions on shopfmt.co.uk, if therefore you do not agree to these terms then do not continue to use the website or place an order.

 

From time to time we may update these terms (and the documents referred to in them) and it is your responsibility to periodically review there terms for any changes.

1. ORDERING & ACCEPTANCE

By placing an order on www.shopfmt.co.uk it will be deemed that you (the customer) have read, understood and are agreeing to be bound by these terms and conditions in their entirety.  After placing your order, we will send you an Order Acknowledgement email and order number which are not an order confirmation or order acceptance from us.

Full acceptance of order will exist once the order has been processed and a confirmation of dispatch email has been sent. Where items are despatched separately, our acceptance of the order in respect of each item takes place when that item is despatched. Our carrier will make every reasonable effort to contact you to make delivery, but if they are unable to do so then your order will be cancelled and payment refunded to your card.

2. PRODUCT AVAILABILITY

All orders are subject to availability.  If a product is out of stock or has been oversold we will attempt to contact you as soon as possible to advise.  We will do our utmost to complete your order but should we be unable to supply the goods for any reason you will not be charge and will receive a refund. We will not be responsible for compensating you if we do not supply the goods.

3. PAYMENT

We take payment on the secure online payment form from you at the time you place your order.  The appropriate authorisation from your card or payment service must be received confirming the full payment amount prior to completion and dispatch of your order.  All payments are made in pounds sterling (£GBP) and are inclusive of VAT. 

 

We cannot accept any liability if payment is refused or declined by your debit/credit card or payment supplier for whatever reason, we reserve the right to reject your order.  We accept no liability for any payments that are misallocated where you have given incorrect information.

It is a crime to purchase or attempt to purchase goods with a stolen method of payment or with a false name or stolen details.  If it is discovered that you were attempting to fraudulently purchase goods from our website we will take the appropriate action.

4. ACCURACY, PRODUCT PRICING & DESCRIPTION

We aim to keep our website as up to date as possible and take all reasonable care to ensure that all details, prices and descriptions are as accurate as possible when they enter our system. On the rare occasion an error is discovered and it affects your order, you will be contacted as soon as possible.  We are not required to sell the goods to you at the price shown and you will have the option to reconfirm your order or cancel it.  If we are unable to contact you, we will consider the incorrectly priced product as cancelled and a refund will be made.

 

Please be aware that the colours and appearance of our products may vary slightly from the way they appear on the screen and we cannot guarantee that your monitor screen will accurately reflect the colour of the product on delivery. All measurements and sizes are approximate, although we make every effort to ensure that they are as accurate as possible.

We reserve the right to make changes to our website content. 

5. DELIVERY

We deliver to the UK only, delivery charges and information can be found on our Delivery page. 

 

Whilst we make every effort to deliver orders in the timescales specified, on some occasions we may be unable to meet with timescales.

We will contact you and ask for your patience if this happens, please rest assured we are doing everything possible to sort this out as we value your business.  Should you not receive your order within 28 days from the ordered date, we do not take liability unless you notify us in writing or by email within 30 days from the order date. 

We reserve the right to wait up to 10 working days from the date of dispatch before taking any further action with regards to undelivered orders.

We shall not accept liability for out of pocket expenses and other costs or losses you may suffer for late or non delivery.  

 

We shall not be liable for failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.

We are sorry but we do not offer collections.

6. RETURNS, DAMAGED OR FAULTY

7. PROMOTIONS

You can only use one promotional code per order.  Promotion codes are not valid in sale periods or on clearance items.  We reserves the right to withdraw any voucher code, without prior notice at any time.  The terms and conditions may vary depending on the offer that is available.

Promotion codes have no cash redemption value. 

If you receive a unique promotion code that is meant just for you, please keep this secret and it is for your usage only.  If we believe a promotion code is being misused in anyway we reserve the right to reject the code and/or cancel your order.

8. INTELLECTUAL PROPERTY & COPYRIGHTS

The intellectual property rights of all website contents made available to you remain the property of shopfmt.co.uk, licensor's or owners and are protected under patent, copyright, trade secret or trademark laws.  You will not modify, adapt, publish, distribute or otherwise reproduce any part of the contents or products without obtaining permission in writing to do so.

If you wish to link to our website or use any content from our website you need to apply in writing to customerservice@shopfmt.co.uk.

10. COMPLAINTS & FEEDBACK

We take all complaints seriously and would ask that you submit your complaint in writing to help@shopfmt.co.uk and we will try our best to resolve any issues as quickly as possible as we really value your business.

When making a comment, mention, feedback, review or other content including images that directly mention shopfmt.co.uk or FM-Tags Ltd we reserve the right to use this content.  We will also reserve the right to delete or ask for the removal of content that directly mentions shopfmt.co.uk or FM-Tags Ltd.

11. FORCE MAJEURE

If we are prevented from or delayed in carrying out obligations under these terms in the event of circumstances beyond our reasonable control, we shall have the right to either suspend deliveries without notice or cancel any orders placed without liability.  This by ways of illustration but without limitations : Strike, lockout, riot, war, flood, epidemic, national emergency, fires, failure of a supplier, machine breakdowns or other causes, whether similar or not.

12. LAW & JURISDICTION


The use of this website and any purchases ares governed by English Law.  Any disputes arising form, or related to, such usage or purchase shall be subject to the exclusive jurisdiction of the courts of England.  These terms and conditions are designed for use within the United Kingdom and under UK Law.
